Commercial and business litigation is a demanding area of the law often requiring the mediator to deal with multiple parties, lawyers and insurance carriers at the same time.  Indispensable to a successful mediation is a mediator's knowledge of business, business cultures, corporate structures and applicable insurances issues.  As a mediator, Jay has mediated some of our region’s biggest and most complex cases.  These have ranged from large national multi-party cases, shareholder disputes, contractual claims, partnership disputes, class actions, business to business claims, and small commercial and business cases. Examples include shareholder disputes involving prominent Kansas City publicly and privately held companies, including H & R Block, Kansas City Southern, Sutherland Lumber, and many more.  National cases have involved multinational drug companies, telephone companies, accounting firms and technology companies.  Besides his judicial and mediation experience in the business and commercial field, Jay Daugherty has extensive personal experience dealing with large businesses.  He is currently Chairman of the Board of the ALS Association which is the world's largest not-for-profit corporation that seeks to find a cure for Lou Gehrig's disease.  The administration of this Washington D.C. based national corporation involves managing hundreds of employees, coordinating the activities of 34 Chapters around the country, facilitating a global research effort and guiding a national fundraising effort.  In addition, as Presiding Judge of the 16th Judicial Circuit Court, Judge Daugherty served as the chief executive officer of the largest trial court in the State of Missouri managing over 900 employees and guiding a broad range of court services.  Both positions, Chairman of the Board and Presiding Judge, required the use of business judgment in the areas of human resources, building and maintenance, budgeting, technology integration, strategic planning and all other areas common to an executive management position.
